Procedure for Submitting a Complaint to the Ethics Committee

The application to the Ethics Committee shall be made in writing and sent to the Chair of the Ethics Committee with the applicant's personal signature by mail to the registered address of the UJA (see Contacts). Anonymous applications will not be considered. Two types of applications to the Ethics Committee are possible: “Request for Assistance” and “Complaint for Action”.

A “Request for Assistance” is made in situations involving controversial ethical issues and interpretations, situations of doubtful ethical conduct or behavior, or manifestations of unethical behavior without causing harm to third parties.

A “Complaint for Action” is made in situations where there are significant violations of the Constitution and the basic principles of the Code of Ethics.

In the event of harm being caused, the application to the Ethics Committee must include a description of the facts, circumstances, identification of the persons involved, and evidence. The violated ethical principles corresponding to the articles of the Code of Ethics must be indicated. Also required is the informed consent of the complainant to use the information provided, and if necessary, the involvement of testimony from third parties and experts.

The Ethics Committee is obliged, within 10 working days from the date of receipt of the application, to inform the applicant whether the application has been accepted for consideration, or the reasons for refusal if the respondent is not a member of the UJA.

The complainant and the respondent must be informed of the names of the persons making the decision regarding the review and must have the opportunity to recuse those persons from the case due to specific circumstances. Agreement on the composition of the committee with both parties shall not exceed 7 days.

The Ethics Committee shall review and discuss the complaint at its meeting if it finds grounds, and shall provide recommendations or make a decision based on established facts. Or it may reject the complaint if it considers the grounds unjustified. It shall inform the complainant thereof and provide reasons for the refusal.

The initial review of the application shall take place within no more than 30 working days. After the initial review, the Ethics Committee shall inform the applicant whether the application has been accepted or rejected for consideration, and in what form it has been accepted.

The time limit for full consideration and decision-making is determined by objective circumstances, but shall not exceed 60 days from the date the application is accepted for consideration. Throughout the entire consideration period, the applicant and all interested parties have the right to inquire about and be informed of the stages of the case review.

The Ethics Committee shall notify all persons mentioned in the applicant's application that the application has been accepted for consideration in one of the two forms, and shall also provide all parties with a copy of the complaint and other materials provided by the complainant, as well as a copy of the “Appeal Procedure”.

In the case of a “Complaint for Action”, as one of the forms, the respondent has the right to submit a counter-application to initiate an appeal process. The respondent shall be given the right to provide the Ethics Committee with their explanations and facts relevant to the case under review.

The appeal procedure shall be in writing and shall be available to the potential complainant in a language known to them.

Dear complainants, please note that all confidential information (content of the complaint, cases of ethics violation, respondent's name, etc.) must be contained in attached files and/or in an official letter sent to the official mailbox of the UJA.

The official letter on the envelope must indicate: strictly confidential!

In the email, the “subject” line must state: for the Ethics Committee strictly confidential! The body of the message must not contain any confidential information.
